Thailand Egg Donor Legal Tips are important for a couple seeking an egg donor in Thailand. Thailand Fertility knows that egg donation is an emotional and sometimes difficult decision for both the egg donor and the intended recipients. Egg donation is a process that has to be well thought of and there should be legal steps in place before the process begins. Therefore, we would like to offer both egg donors and some legal tips to ensuring the process goes as smoothly and successfully as possible.
First, the egg donor’s release of claim is very important. One of the most typical debates in the egg donation process is who owns the eggs after the egg retrieval is carried out. Equally important is what claim does either party have if a child is produced from the donor’s eggs. It becomes imperative here for the egg donor to fully understand the legal contract she will have to sign with the fertility hospital and/or agency managing the egg donation process. The contact must include a clause that clearly states that the egg donor gives up all legal rights of her eggs after the egg retrieval takes place. What is really important, though, is the contract should state that the egg donor not give up any legal rights of her eggs “prior” to the egg retrieval or the egg donation agency or fertility hospital could govern the egg donor’s lifestyle. After all, she may change her mind and decide half way through the process not to donate her eggs. That should be a right that she protects.
Second, it is important that the intended parents or recipients stake their claim. Just as the egg donor is protecting her rights over her eggs, the recipients should also have the right to assert claim over the donated eggs. The recipients must ensure that the contract has a clause that clearly states that they own the eggs after the egg retrieval is carried out and will be the parents of any subsequent child that is born from the donated eggs. This will protect the recipients and releases the egg donor of any future claims she may make regarding parentage.
Third, it’s important that egg donors eliminate their responsibility. Egg donors should release themselves of any responsibility after the egg retrieval is carried out. Sometimes couples cannot get pregnant with the donors eggs or there could be situations where developmental problems could occur in the born child. As with any contracts, there has to be a time frame where responsibility ends. The contract must include such a clause. If not, intended parents could come back and try and sue the egg donor claiming her eggs were not good when in fact they were examined by medical professionals and deemed good.
Fourth, privacy plays such an important role in the egg donation process. Unless the egg donor and the intended parents agree to a mutual relationship, which we do not suggest, it’s imperative that the contract maintains privacy for those involved. The egg donation process should be an anonymous one. This ensures later on the child does not try and locate the egg donor or other problems can occur between husband and wife regarding the egg donor, so privacy is extremely important.
Finally, we recommend that the intended parents use a reputable egg donation agency. Egg donation in Thailand is a very serious issue and it is not highly regulated and the laws regarding it are often cloudy. Intended parents should thoroughly investigate the agency and try and get testimonials from other parents who had success using the agency. A reputable fertility agency in Thailand will be happy to provide referrals and testimonials. If they are apprehensive of doing so, it is better not to use them and find someone else. We hoped you enjoyed reading these Thailand legal tips on egg donation in Thailand and wish that your quest to have a child becomes a reality.
